1. Agreement to Terms

By accessing and using Trial Announcer ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and Trial Announcer, a service operated from England. These Terms are governed by the laws of England and Wales.

2. Description of Service

Trial Announcer is a clinical trial notification platform that:

• Scrapes publicly available clinical trial information from participating companies
• Matches trials to your specified criteria (age, BMI, location, etc.)
• Sends notifications via your chosen channels (email, Discord, Telegram, web push)
• Provides a dashboard to manage alerts and view matched trials

3. User Accounts

3.1 Account Creation

You must be at least 18 years old to use this Service. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activity.

4. Subscription and Payment

4.1 Free Tier

The free tier allows up to 2 active alerts with basic notification features.

4.2 Pro Subscription

The Pro subscription is charged monthly at the rate displayed on our pricing page. Payments are processed securely through Stripe. By subscribing, you authorise us to charge the payment method on file.

4.3 Billing and Renewal

Subscriptions automatically renew unless cancelled before the renewal date. You will not receive a refund for any unused portion of your subscription period.

4.4 Cancellation

You may cancel your subscription at any time through your account dashboard. Upon cancellation, you will retain access until the end of your current billing period.

4.5 Refund Policy

Refunds are not provided for partial subscription periods. If you believe you have been incorrectly charged, contact [email protected] within 7 days.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorised access to our systems
• Interfere with or disrupt the Service or servers
• Use automated systems (bots, scrapers) to access the Service beyond your account
• Reverse engineer or attempt to extract source code
• Resell or redistribute the Service without permission
• Provide false or misleading information

6. Intellectual Property

The Service, including all content, features, and functionality, is owned by Trial Announcer and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

7. Clinical Trial Information

7.1 Information Accuracy

We aggregate clinical trial information from third-party sources. While we strive for accuracy, we do not guarantee the completeness, accuracy, or timeliness of this information. Always verify trial details directly with the trial sponsor.

7.2 Not Medical Advice

The Service is for informational purposes only and does not constitute medical advice. Consult with qualified healthcare professionals before participating in any clinical trial.

7.3 No Endorsement

Listing of clinical trials does not constitute an endorsement or recommendation by Trial Announcer.

8. Disclaimers and Limitation of Liability

8.1 "As Is" Basis

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

8.2 Service Availability

We do not guarantee that the Service will be uninterrupted, secure, or error-free. We may suspend or discontinue the Service at any time.

8.3 Limitation of Liability

To the fullest extent permitted by law, Trial Announcer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the Service
• Any unauthorised access to or use of our servers
• Any bugs, viruses, or other harmful code
• Any errors or omissions in trial information
• Participation or non-participation in any clinical trial

Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

8.4 UK Consumer Rights

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under UK law. If you are a consumer, you have certain statutory rights under the Consumer Rights Act 2015 that cannot be excluded.

9. Indemnification

You agree to indemnify and hold harmless Trial Announcer and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or through the Service. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.
